Terms of service.

In plain English, then the legal version. Last updated May 2026.

The short version

Month-to-month. 30 days notice to cancel. Everything we build is in your name and stays with you. We do our best work, you pay on time, both sides act in good faith. No long-term lock-in. No hidden cancellation fees.

1 · Agreement

By engaging Heist Marketing for services, you agree to these terms. The relationship is month-to-month and begins on the start date defined in your engagement letter.

2 · Term and cancellation

No long-term contracts. Either party may end the engagement with 30 days written notice. Notice can be by email to [email protected].

Your final month is billed in full and active services continue through the notice period. There are no cancellation fees, no kill fees, and no penalties.

3 · Ownership of work

Everything we build for you is yours. Specifically:

  • Your website code and files belong to you and live on your hosting account.
  • Your CRM is built inside your account.
  • Your Google Business Profile is in your name; we manage with your permission.
  • Your domain stays with your registrar in your name.
  • Your content, brand assets, and campaign data are yours.

On cancellation, we hand off access and walk you through the keys. No data is held hostage.

4 · Payment

Retainers are billed monthly in advance via the payment method on file. Failed or late payments are followed up via direct conversation, not legal threats. After 15 days past due, services pause until payment is resolved.

5 · Ad spend

Ad spend is separate from your retainer. You pay platforms (Google, Facebook, LSA) directly through your own billing account. We don't mark up media. We manage spend transparently and you can see every dollar.

6 · Scope and revisions

Each package describes what's included. Out-of-scope work is quoted in writing and approved by you before any time is spent on it. Reasonable revisions are part of the work — we don't nickel-and-dime.

7 · Communication

Craig is your direct point of contact. Reasonable response times: same business day for emails and texts, same-day for urgent matters. We don't operate via portal or ticket queue.

8 · Confidentiality

We treat your business information as confidential. We may reference our work for you in case studies or marketing only with your written permission, and we'll always check first.

9 · Limitations

Marketing involves third-party platforms (Google, Meta, etc.) whose rules and algorithms change. We work to keep performance steady but cannot guarantee specific rankings or lead volumes. We commit to the work, the transparency, and the partnership — not to outcomes we don't control.

10 · Governing law

These terms are governed by the laws of the State of Tennessee. Disputes will be resolved first through direct conversation, then mediation if needed, before any other legal action.

11 · Changes

If we update these terms, active clients are notified by email at least 30 days before changes take effect.
